Privacy Policy

Data Conversion Laboratory, Inc. (“Data Conversion Laboratory”) has created this privacy policy to describe how we collect, use and disclose the information that we obtain from our users through the Data Conversion Laboratory Website(s), (the “Site”), https://www.dclab.com,  and data we collect through the services we provide (“Services”) to customers (“Customers”).  This policy also describes the choices available to you regarding our use of your personal information and how you can access and update this information.  By visiting the Site and using any of our Services, you signify your explicit consent to the terms and conditions of this Policy.

 

The use of information collected through our Services shall be limited to the purpose of providing the specific Service for which the Customers have engaged Data Conversion Laboratory.

 

EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield

Data Conversion Laboratory, from time to time, may handle personal information collected from individuals located within European Union member countries and Switzerland. Data Conversion Laboratory complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States.  Data Conversion Laboratory has certified to the Department of Commerce that it adheres to the Privacy Shield Principles.  If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.  To learn more about the Privacy Shield program, and to view our certification, please visit https://www.privacyshield.gov/.

 

Data Conversion Laboratory is responsible for the processing of personal data it receives, under EU-U.S. Privacy Shield Framework and the Swiss–U.S. Privacy Shield Framework, and may subsequently transfer to a third party acting as an agent on its behalf. Data Conversion Laboratory complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

An individual who seeks access to their data, seeks to correct, amend or delete inaccurate data, or wishes to opt-out of communications from Data Conversion Laboratory should direct his/her query to privacy@dclab.com.

 

Data Conversion Laboratory commits to cooperate with EU Data Protection Authorities (DPAs) and Swiss Federal Data Protection and Information Commissioner, with regard to unresolved Privacy Shield complaints concerning human resources data transferred from EU and Switzerland in the context of the employment relationship.

 

With respect to personal data received or transferred pursuant to the EU–U.S. Privacy Shield Framework and the Swiss–U.S. Privacy Shield Framework, Data Conversion Laboratory is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission.   In certain situations, Data Conversion Laboratory may be required to disclose personal data in response to lawful requests by public authorities, including meeting national security or law enforcement requirements.

 

Data Conversion Laboratory has further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, please contact our U.S.-based third party dispute resolution provider at https://www.jamsadr.com/eu-us-privacy-shield.  This service is provided at no cost to you.

 

Under certain conditions, more fully described on the Privacy Shield website, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.

 

What Information Do We Collect About You?

When You Visit Our Site

We may collect personal information about you when you visit our Site.  Some information is provided by you. For example, first name, last name, address, telephone number, email address, job title, and organization (personally identifiable information, or “Personal Information”) when you complete our online contact form or requesting a quote for a complex digital content challenge. We also collect personally identifiable information when you subscribe to marketing communications, request support, use our on-demand services or when you sign up for a webinar.  This information may be used for follow-up marketing and other relevant communications. 

 

When you visit our Site, we may also collect information that does not necessarily reveal your identity directly but may include information about the specific device you are using or location, such as the hardware model, operating system version, web-browser software (such as Firefox, Chrome, Safari, or Internet Explorer) and your Internet Protocol (IP) address/MAC address/device identifier.  This may be used to help resolve technical issues and provide analytics and metrics.

 

We also automatically collect and store certain information in server logs such as but not exclusive to: statistics on your activities on our Site, mobile apps, and products; information about how you came to and used our Site, related visits, mobile apps, and products; your IP address; device type and unique device identification numbers, device event information (such as crashes, system activity and hardware settings, browser type, browser language, the date and time of your request and referral URL), broad geographic location (e.g. country or city-level location) and other technical data including how your device has interacted with our Site, the pages accessed and links clicked. 

 

Some of this information is collected through technologies that uniquely identify your browser, including cookies.  A cookie is a small amount of data, which often includes an anonymous unique identifier sent to a browser from a Site's servers and stored on a computer's hard drive.

 

When You Use Our Services

As part of digitizing and making content smarter (data conversion), our customers may submit or upload or request that we obtain from other sources, structured and unstructured content for processing.  This structured or unstructured content may contain personal information such as email addresses and author names. 

 

This customer content is processed by Data Conversion Laboratory on behalf of the customer. Our privacy practices will be governed by the contract that we have in place with our customers.  In accordance with such terms, Data Conversion Laboratory will process such customer content for the purposes of providing the relevant services and in accordance with our customer's instructions.

 

When you request our services to review and process your data, we will secure your information, physical documents as well as storage media, as per our mutually agreed contract terms.   This information will be used to deliver the agreed services.

How Will We Use the Information We Collect?

We may use information collected when you visit our Site or when you use our services for the following business purposes:

  • Respond to your requests or provide information you requested

  • Provide agreed contract services against subject data and content

  • Improve service reliability, features and functionality

  • Better understand customer experience and to improve quality

  • Enhance security, monitor and verify identity or access

  • Detect fraud and other abuses for our Site

 

How We Secure Your Information?

Your information is secured within the Data Conversion Laboratory network as well as authorized third-party sites contracted to host specific, secured services.  All contracted third-party sites have a posted U.S. Privacy Shield.

 

To Whom Do We Disclose Information We Collect?

Data Conversion Laboratory may transfer personal information to other companies that help us provide our service.  These companies are authorized to use your personal information only as necessary to provide these services to us. Transfers to subsequent third parties are covered by the provisions in this Policy regarding notice and choice and the service agreements with our Customers.  We do not sell your personal information to third parties. 

 

Data Controlled by Data Conversion Laboratory

Upon request, Data Conversion Laboratory will provide you with information about whether we hold any of your personal information. You may access, correct, or request deletion of your personal information by contacting us via email. We will respond to your request within a reasonable timeframe.

 

Data Controlled by Our Clients

Data Conversion Laboratory acknowledges as a processor of our clients’ data that you have the right to access your personal information. Data Conversion Laboratory has no direct relationship with the individuals whose personal data it processes. Therefore, an individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to the Data Conversion Laboratory Client (the data controller). If requested to remove data, we will respond within a reasonable time frame.

 

How Long We Retain Your Information?

Data Conversion Laboratory will retain personal information we process on behalf of our customers for as long as needed to provide services and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

 

How to Opt-In/Opt-Out?

If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. If you wish to unsubscribe to our newsletter or marketing emails, you may choose to stop receiving our communication by following the unsubscribe instructions included in those emails.

 

Your Rights Over Your Information

By law, you can ask us what information we hold about you, and you can ask us to correct it if it is inaccurate.  You can also ask for it to be erased and you can ask for us to give you a copy of the information.
